Terms of Use — ImIn Community

Welcome to ImIn ("we," "our," "us," or "ImIn Community"). ImIn Community is operated by Hedi Ben Jaafer, based in Quebec, Canada.

These Terms of Use ("Terms") govern your access to and use of the ImIn mobile application ("the App") and all related services. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and ImIn Community. Please read them carefully.


1. Eligibility

To use ImIn, you must:

  • Be at least 18 years of age. The App is rated 17+ on the Apple App Store and is intended exclusively for adults.
  • Have the legal capacity to enter into a binding agreement.
  • Not have been previously banned or removed from the App.
  • Not be required to register as a sex offender in any jurisdiction.

By creating an account, you represent and warrant that you meet all of the above eligibility requirements. If we discover that you do not meet these requirements, we may terminate your account immediately without notice.


2. Account Registration and Security

When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information.
  • Keep your login credentials confidential and not share them with any third party.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately at contact@imincommunity.com if you suspect unauthorized use of your account.

You may authenticate via email/password, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the security of your chosen authentication method.


3. Nature of the Service — Platform Disclaimer

ImIn is a platform that enables users to discover, organize, and join activities and meetups. ImIn is NOT an organizer, host, or participant in any activity.

You understand and agree that:

  • ImIn provides the technology platform only. We do not organize, supervise, manage, or control any activity, meetup, or interaction that takes place through or as a result of the App.
  • ImIn does not employ, contract, or agent any user. All users act independently and on their own behalf.
  • ImIn does not screen, vet, background-check, or investigate users beyond the voluntary verification features described in Section 7.
  • ImIn has no control over the quality, safety, legality, or suitability of any activity, the accuracy of activity listings, or the ability of users to follow through on their commitments.
  • Any interaction, meetup, or activity you participate in through ImIn is entirely at your own initiative and discretion.

4. Assumption of Risk

BY USING IMIN AND PARTICIPATING IN ANY ACTIVITY DISCOVERED, ORGANIZED, OR FACILITATED THROUGH THE APP, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH SUCH ACTIVITIES, INCLUDING BUT NOT LIMITED TO:

  • Physical risks: Personal injury, illness, disability, or death arising from participation in activities, sports, outdoor events, or any in-person meetup.
  • Property risks: Damage to or loss of personal property.
  • Interpersonal risks: Interactions with other users who may be strangers, including the risk of misconduct, harassment, dishonesty, or criminal behavior by other users.
  • Environmental risks: Risks associated with the location, weather conditions, or environment where an activity takes place.
  • Transportation risks: Risks associated with traveling to and from activities.

You acknowledge that in-person meetups with people you have met online carry inherent risks that cannot be fully eliminated. You accept sole responsibility for your own safety and for assessing whether any activity, location, or interaction is appropriate for you.

We strongly encourage all users to:

  • Meet in public, well-lit locations for initial encounters.
  • Inform a friend or family member of your plans, including the activity details, location, and expected return time.
  • Trust your instincts — if something feels unsafe, leave immediately.
  • Never share personal financial information, home address, or sensitive details with users you do not know.
  • Report any suspicious, threatening, or inappropriate behavior immediately through the App's reporting tools.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE LAWS OF QUEBEC AND CANADA:

5.1 Disclaimer of Liability for User Interactions

ImIn Community, its founder, officers, employees, agents, and affiliates shall NOT be liable for any damages, claims, losses, costs, or expenses of any kind (including but not limited to direct, indirect, incidental, consequential, special, punitive, or exemplary damages) arising out of or related to:

  • Any interaction, meetup, activity, or communication between users, whether conducted in person, online, or through the App's chat features.
  • Any act, omission, conduct, behavior, or statement by any user, whether online or offline.
  • Any personal injury, property damage, emotional distress, or death resulting from your use of the App or participation in any activity.
  • Any dispute between users.

5.2 General Limitation

In no event shall ImIn Community's total aggregate liability to you for all claims arising out of or related to these Terms or your use of the App exceed the greater of: (a) the amount you paid to ImIn Community in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).

5.3 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

5.4 Quebec Consumer Protection

Nothing in these Terms is intended to exclude or limit any rights you may have under the Quebec Consumer Protection Act (Loi sur la protection du consommateur) that cannot be excluded or limited by law. To the extent that any provision of these Terms conflicts with mandatory consumer protection legislation in Quebec, the mandatory legislation shall prevail with respect to that provision only.


6. Indemnification

You agree to indemnify, defend, and hold harmless ImIn Community, its founder, officers, employees, agents, and affiliates from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the App or participation in any activity.
  • Your violation of these Terms.
  • Your violation of any law or regulation.
  • Your content or conduct, whether online or offline.
  • Any interaction between you and any other user.
  • Any claim by a third party arising from your acts or omissions in connection with any activity.

This indemnification obligation shall survive the termination of your account and these Terms.


7. Verification System Disclaimer

ImIn offers a voluntary, multi-level verification system:

  • Level 1 (Basic): Requires a complete profile (photo, bio, interests, social link).
  • Level 2 (Trusted): Requires positive reviews from other users.
  • Level 3 (Community): Requires endorsements from other verified users.

You understand and agree that:

  • Verification levels are based on user-provided information and community feedback. They do NOT constitute a background check, identity verification, criminal record check, or any guarantee of a user's character, intentions, reliability, or safety.
  • A verified user is NOT a "safe" user. Verification indicates only that the user has completed certain profile and community milestones.
  • ImIn does NOT guarantee the accuracy of any information provided by users, including verified users.
  • You should not rely solely on verification levels or trust scores when deciding whether to meet someone in person. Always exercise your own judgment and follow the safety guidelines in Section 4.
  • ImIn shall not be liable for any harm caused by a verified user.

8. User Conduct and Community Guidelines

By using ImIn, you agree NOT to:

  • Use the App if you are under 18 years of age.
  • Impersonate another person or misrepresent your identity, age, or affiliation.
  • Create false, misleading, or fraudulent activity listings.
  • Post, upload, or share any content that is offensive, violent, hateful, discriminatory, pornographic, sexually explicit, or exploitative.
  • Harass, bully, threaten, stalk, or abuse any other user, whether through the App or at in-person activities.
  • Use the App for any illegal purpose or to facilitate any illegal activity.
  • Use the App to solicit money, promote commercial products, or engage in spam.
  • Attempt to collect personal information from other users for purposes not related to activities.
  • Interfere with or disrupt the App's functionality or servers.
  • Circumvent or manipulate the verification system, trust scores, reviews, or any App feature.
  • Create multiple accounts or create a new account after being banned.
  • Use automated means (bots, scrapers, crawlers) to access the App.

Zero Tolerance Policy: Any violation of these rules may result in immediate removal of content, suspension, or permanent termination of your account without prior notice. We reserve the right to report illegal activity to law enforcement authorities.


9. User-Generated Content

9.1 Your Content

You retain ownership of the content you create and share through the App (activities, messages, photos, reviews, endorsements). By posting content, you grant ImIn a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, display, reproduce, modify, and distribute your content solely for the purpose of operating and improving the App.

9.2 Content Standards

All content must comply with the Community Guidelines in Section 8. You are solely responsible for any content you post and the consequences of sharing it.

9.3 Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms or that we deem inappropriate, at our sole discretion. Users can report objectionable content using the built-in reporting tools. We commit to reviewing reported content and taking appropriate action within 24 hours.

9.4 No Obligation to Monitor

While we may moderate content, we are under no obligation to monitor, review, or pre-screen all user-generated content. The presence of content on the App does not imply our endorsement or approval.


10. Pulse Feature (Instant Invites)

Pulses are time-limited, location-based invitations sent to nearby users. You understand that:

  • Pulses use your approximate location (geohash) to reach nearby users. Your exact location is never shared with other users.
  • Pulses expire after 30-90 minutes and are not stored permanently.
  • Responding to a Pulse is voluntary. You are not obligated to participate in any activity.
  • The same assumption of risk (Section 4) and limitation of liability (Section 5) apply to all Pulse-initiated meetups.

11. Subscriptions and Payments

11.1 ImIn Plus Subscriptions

ImIn offers optional paid subscriptions ("ImIn Plus") through Apple's App Store:

  • Premium: $3.99 USD/month or $38.30 USD/year
  • Creator: $9.99 USD/month or $95.90 USD/year

11.2 Billing and Renewal

All purchases are processed by Apple through the App Store. ImIn does not collect or store your payment information. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID settings (Settings > Apple ID > Subscriptions).

11.3 Refunds

All refund requests must be directed to Apple, as they process all payments. ImIn does not have the ability to issue refunds directly. You can request a refund from Apple at https://reportaproblem.apple.com.

11.4 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the subscription after the price change constitutes your agreement to the new price.

11.5 Free Trial

If offered, free trial periods automatically convert to paid subscriptions unless cancelled before the trial ends. Any unused portion of a free trial is forfeited upon purchasing a subscription.


12. User Blocking and Reporting

  • You may block any user at any time. Blocked users will no longer be able to interact with you, view your profile, or see your activities.
  • You may report any user or content that violates these Terms using the in-app reporting tools.
  • We take reports seriously and will investigate promptly. However, we do not guarantee any specific outcome from a report.
  • False or malicious reporting may result in action against your own account.

13. Account Suspension and Termination

13.1 By You

You may delete your account at any time through the App (Settings > Account > Delete Account). Account deletion will remove your data from our active systems within 30 days, as described in our Privacy Policy.

13.2 By Us

We may suspend or terminate your account, with or without notice, for any reason, including but not limited to: violation of these Terms, reports from other users, suspected fraudulent or illegal activity, extended inactivity, or at our sole discretion.

13.3 Effect of Termination

Upon termination: your right to use the App ceases immediately; any active subscription will not be refunded for the remaining period (you may request a refund from Apple); your content may be removed; and Sections 4, 5, 6, 7, 14, 15, and 16 of these Terms shall survive termination.


14. Intellectual Property

The ImIn name, logo, design, features, functionality, and all related content and materials are the exclusive property of ImIn Community and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or exploit any part of the App without our prior written consent.


15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

15.2 Informal Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at contact@imincommunity.com. We will attempt to resolve the dispute within 30 days.

15.3 Jurisdiction

If informal resolution fails, any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of the judicial district of Montreal, Quebec, Canada. You consent to the personal jurisdiction of such courts.

15.4 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class, consolidated, or representative action.

15.5 Limitation Period

Any claim arising out of or related to these Terms or your use of the App must be filed within one (1) year after the cause of action arises, or it shall be permanently barred, except where a longer limitation period is required by mandatory applicable law.


16. Safety Recommendations

While ImIn is not responsible for user safety at in-person meetups (see Sections 3, 4, and 5), we care about our community and strongly recommend the following safety practices:

  • Meet publicly: Choose public, well-populated venues for first meetups.
  • Tell someone: Share your plans (activity, location, time, who you're meeting) with a trusted friend or family member.
  • Stay sober: Avoid excessive alcohol or substance use when meeting people for the first time.
  • Arrange your own transportation: Drive yourself or use your own transportation so you can leave independently at any time.
  • Trust your instincts: If something doesn't feel right, leave. Your safety is more important than being polite.
  • Report concerns: Use the in-app reporting tools to flag any behavior that makes you uncomfortable, before, during, or after an activity.
  • Verify profiles: While verification levels are not guarantees (see Section 7), they provide an additional layer of community accountability.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ImIn Community regarding your use of the App.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17.5 Notices

We may provide notices to you via the App, email, or by posting on our website. You may send notices to us at contact@imincommunity.com.


18. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via in-app notification or email at least 14 days before they take effect. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App and delete your account.
